not sure about that. With the precedent of the saints' case, goodell established that the nfl will follow the same principle as the navy: The captain is responsible for everything that happens. So even though the report does not condemn belichick, i think he gets a penalty as severe as payton. Ignorance of the cheating (not that i really think belichick was ignorant of it) is no excuse.

That said, even the court of law, which is held to a MUCH higher burden on proof, can convict without 100% proof. Look at Hernandez. There is no video of him shooting Lloyd. But the other evidence makes a case that no reasonable person can defend.

In this case, there is no video of a needle entering a football. But there is plenty of evidence of wrongdoing. And the lack of a video suggests that the Pats deliberately concealed what they did, which is an admission of guilt. They didn't fully cooperate with the investigation, and still there is enough evidence to reasonably presume the Pats did it, with Brady at least knowing if not being more directly involved. And unlike the judicial system, there is no presumption of innocence. This is a private matter. The league can do whatever it wants.

Bill Polian cleared this up today on NFL Live (ESPN). He sat on the competition committee for many years and helped write the bylaws, and he said you don't need a smoking gun, all thats required is a preponderance of evidence that points to probable guilt, thats why the Wells reports conclusion is suffice to establish guilt and the subsequent punishment.

I would argue this is the equivalent of a doctored bat in baseball, corked. Maybe a scuffed ball, but it seems like it was doctored behind the scenes, which suggests a conspiracy. A ball is scuffed secretly during play. A bat is corked in private.

Should the coach be held responsible? When an organization prides itself on the HC keeping tight reins, and knowing EVERYTHING that happens with the team, he can't feign ignorance.

It is more like a civil trial than a criminal one, and preponderance of evidence is enough for the competition committee.

I find it funny that the officials told Brady he could use a kicking ball to start the second half because the game balls were still being tested and he refused.

This is not a case, this is a league with a commissioner who has his own discretion to decide a punishment within any confines of the cba. The force keeping Goodell honest, is 31 other owners, and the saints in particular

Plus testimony of a cursing official wondering why the balls disappeared from the officials' locker room. - More than enough evidence for a heavy set of penalties.

Absolutely. There is more than enough evidence to suggest the Patriots deserve punishment. Aside from the tests which show the Pats' footballs deflated and not the Colts', and neither team's footballs deflated in the second half, you have to consider the violation of a league rule when McNally took the ball bag from the officials' room without express permission from the officials.

1. They didn't allow investigators to follow up with McNally when they requested it.
2. Brady refused the investigators' request to examine his electronic correspondence.
3. They didn't allow an in-person meeting, or even the chance to know the identity of, this JF from Quincy, only allowing a phone interview which was monitored by Patriots legal counsel.

I don't know what his definition of "cooperate" is, but that is not it.

Absolutely. There is more than enough evidence to suggest the Patriots deserve punishment. Aside from the tests which show the Pats' footballs deflated and not the Colts', and neither team's footballs deflated in the second half, you have to consider the violation of a league rule when McNally took the ball bag from the officials' room without express permission from the officials.

And let's add in the Pats' refusal to cooperate with the investigation: Brady refusing to hand over his phone to investigators plus the Pats' refusing to make McNally available for further interviews. - The more I think about the contents of that report, the better I feel about my penalty predictions. Heck, I think Brady simply refusing to hand over his phone alone would get him suspended for a few games. So for the whole ball of wax. including the texting evidence that he directed the deflation to get done? I think a 1 year suspension for him is a reasonable guess.

I know a lot of people would disagree with very good reason but that is why I said I would like to see congress get involved. I would like to see a report that has the power of the subpoena behind it written and turned in.
