I was watching Entourage the other day, from a few years ago, and Ari is trying to bring an NFL franchise to LA. They keep talking about how "the NFL doesn't do scandal," and how if there's even a HINT of scandal, the NFL won't get involved. Seems quaint now.

I wonder what new evidence Brady wishes to bring to light here. He could, of course, release the electronic records he refused to hand over to the investigators. After all, if he's innocent, that will exonerate him.

today goodell is hearing brady's appeal. will be interesting to see if he lessens the suspension. my guess is it is reduced to 2 games.

as a side note, i happen to work a couple of blocks away from the league's offices in midtown. as i was coming from the subway on the way to my office, there must have been 10 news trucks and a mob of cameras and people camped out in front of the building, assumedly awaiting brady's arrival. quite the spectacle.

Report: Tom Brady “testifying under oath” at appeal hearing

Despite the small army of lawyers dispatched by both sides, today’s Tom Brady appeal hearing is not happening in a courtroom. But it still has the feel of a trial, right down to the Bible, apparently.

According to Adam Schefter of ESPN, Brady “is testifying under oath, per source.”

While that makes it sound like the previously zipped-up Brady is going to be totally honest, it’s also hard to figure out what exactly it means. (Place your right hand on the 2011 Collective Bargaining Agreement. Do you swear to Roger to tell the whole truth, …)

While we won’t be provided with a transcript of today’s hearing — that’ll have to wait until the get to an actual courtroom — the leaks in this one will be fascinating.

And they might be more profound than the amount of air that may or may not have leaked out of any footballs.

Why should the penalty be reduced ? No new evidence, so keep the penalty the same. I will have no respect for the Commish if he reduces the penalty to two games.

not sure what he can say or do to lessen the suspension, but it will be interesting to say the least what happens today.

He threatens to sue the league for defamation of character. League does not want this in court where evidence/testimony would be made public. So they agree to compromise. 2 games.

The most surprising part to me in the article is this:

The expectation is that Brady won't turn over his cell phone and that the commissioner won't, in turn, reduce Brady's punishment. That means this thing is likely headed to federal court.

From the way most people are talking, it seems the expectation is that the suspension will be reduced. The article doesn't say where the "expectation" comes from, but at least it's refreshing to see that at least some feel the suspension will be maintained at 4 games.

And I really wonder if this would be taken to federal court, what with all that implies.

what implications would it have on the league if it is taken to a federal court? sorry about the dumb questions but besides the obvious I am not a lawyer. So I can def say it will tarnish some images but besides that not sure what taking it to federal court will accompolish. We already know they cheat but for some reason they can't take way the SB trophies and it seems likely brady and belli will still go into the hall of fame.

If it goes to court, Brady et al will have to provide the evidence required by the court. He can't refuse to turn over the phone records etc. He can't stonewall like he has with the NFL, it's a different game.

I'm sure his lawyers have discussed this with him and, also, I doubt that he wants a lawsuit on his mind heading into the season.

If he tries to get an injunction postponing the suspension until it gets worked out in court or otherwise, he may or may not be successful.

Agreed. That's why I think he never had any intention of going to court.

If it remains four games, Brady's legacy is destroyed. If the suspension is eliminated, Goodell's legacy is destroyed. The problem is, to justify dropping it from 4 to 2 games (and save face for both), there needs to be a compelling reason. Unless Brady hands over his records, what is that reason?

I've always agreed with four games, but as an end game. The league should have lessened the draft pick penalties and given Brady eight games. This way, cut it to four on appeal, and everyone saves at least a small level of dignity. Two games for what Brady did is an outrage, but it seems like it's the only reasonable solution now.

Kraft has plenty of buddies on the bench. And if it went to court in New England, the judge with the Patriots bumper sticker on his car wouldn't recuse himself.

thought federal meant it goes to DC not New England.
