Plaintiff claims punch from Brandon Marshall caused lingering eye, neck, and back injuries

AP
Tuesday was a bizarre day for Jets receiver Brandon Marshall.
It ended with Marshall receiving the Ernie Accorsi Humanitarian Award from the New York Athletic Club. It began with a trial in a civil claim brought by a woman he allegedly punched in the face four years ago.
Via the Associated Press, a “sobbing” Christin Myles said that the blow has resulted in lingering eye, neck, and back injuries.
Marshall was present for opening statements and the testimony from Myles. The presentation included surveillance video of an incident that happened inside the Marquee nightclub on March 11, 2012, with a pair champagne bottles and ice buckets tossed toward a group that included Marshall, his wife, and former NFL receiver Mike Sims-Walker. A bottle cut Marshall’s wife on the lip, and they left the club to wait for an ambulance.
Myles, who testified that she had gone to the restroom when the altercation occurred, became angry when she realized that what had been her 24th birthday celebration had ended prematurely due to the incident. She said she took a swing at Sims-Walker, and that she then was struck by Marshall.
“The next moment, I remember I just saw an arm with tattoos and a blue sleeve rolled up,” Myles said. “I remember falling to the floor.”
According to the report from the Associated Press, Myles at that point began crying so hard that the presiding judge called for a break.
Lawyer Harvey Steinberg, who has become the attorney of choice for basically every current or former Broncos player or coach, is representing Marshall in the trial. Steinberg suggested that the lawsuit traces directly to Marshall’s fame and wealth.
“I have a feeling if he wasn’t a professional athlete we wouldn’t be in this courtroom,” Steinberg said.
That’s a risky move. If the jurors believe that Marshall punched Myles and if they believe that her injuries are what she claims they are, the strategy of suggesting that she’s simply chasing a payday could backfire.
Marshall, who wasn’t charged as a result of the incident, is expected to testify during the trial.

this is a civil trial. no criminal charges were ever brought against marshall. plus it happened 4 years ago, so i don't know how you can retroactively punish someone under new league discipline rules.

while we can never account for what the league will do, i have a hard time seeing this leading to any suspension

He is not being charged with any criminal offenses. There is no question of guilty or innocent. It is a civil trial.

Never did I say Court finding him guilty But there is a higher authority. All I am saying if he is guilty then he is a low life.

He may be completely innocent

Legal troubles[edit]

According to Orlando-Orange County public records (case 48-2004-MM-012392-O), on Halloween 2004, while a student at UCF, Marshall was arrested in Orlando on charges of assault on a law enforcement officer, refusal to obey, disorderly conduct, and resisting an officer.[85]

On January 1, 2007, Marshall was present at The Shelter, a nightclub in Denver, Colorado, along with teammates Javon Walker and Darrent Williams. The trio was attending a birthday party held for and by Denver Nuggets forward Kenyon Martin. As the players were leaving the club in a limousine, Williams was fatally shot in the neck after an unknown assailant opened fire on the vehicle. Willie Clark was later charged with the murder.[86] Walker has stated in interviews that the shooter was likely a nightclub patron whose motive was retaliation after being involved in an altercation with Marshall's cousin earlier that night.[87][88]

On March 26, 2007, Marshall was arrested in the Highlands Ranch suburb of Denver on suspicion of domestic violence after his girlfriend reported that following a domestic dispute, Marshall prevented a taxi she was in from leaving his house.[89] Charges from the incident were later dismissed on May 25, 2007, after Marshall completed anger management counseling.[90]

In the early morning of October 22, 2007, Marshall was arrested in the Denver-Aurora metropolitan area at the intersection of 14th and Blake St. for driving under the influence of alcohol.[91] A trial was scheduled for September 16, but Marshall instead agreed to a plea bargain four days earlier; he pleaded guilty to a reduced charge of driving while ability impaired.[92] He was sentenced to one-year probation and 24 hours of community service.

On June 12, 2008, Marshall was ticketed for an illegal lane change, then found to be without his license and proof of insurance.[93] The case was eventually dropped as part of a plea bargain for the October 22, 2007 driving incident involving alcohol.[92]

A September 17, 2008 article on CompleteColorado.com stated that the solicitor's office in Fulton County, Georgia filed misdemeanor battery charges on September 10 for an alleged incident on March 4, 2008, in Atlanta, Georgia. Marshall was booked on March 6, then released the next day after posting a $1,000 cash bond.[94] The case was assigned to Judge John Mather in Georgia state court.[95] On August 14, 2009, a jury in Atlanta found Marshall not guilty.[96]

On March 1, 2009, Marshall was arrested in Atlanta for disorderly conduct after allegedly being involved in a fight with his fiancee, Michi Nogami-Campbell. Marshall was released on a $300 bond.[97] The charges were dropped the following day.[98]

On April 23, 2011, Marshall was stabbed near his stomach by his wife, Michi Nogami-Marshall. He was taken to a hospital and was released two days later. He has since made a full recovery.[99][100]

It was later revealed by police that Marshall's wife did make a brief 911 call, but it only described an unspecified emergency and no mention of a stabbing ever took place. She was charged with aggravated battery with a deadly weapon and is free on $7,500 bail.

In a South Florida Sun-Sentinel article published on July 30, 2011, it was revealed that Marshall was diagnosed with borderline personality disorder at Boston's McLean Hospital after his incident with Nogami-Campbell.[101] He is currently pursuing treatment for his mental illness and filming a documentary about his struggle.

On early Sunday, March 11, 2012, two days before his trade to the Bears, Marshall was accused of hitting a woman in the face at a New York club and being involved in a melee. The New York Post stated that Marshall, his wife and some friends were at Marquee when a brawl ensued, and Marshall punched the woman below her left eye, although he may have been attempting to hit the woman's friends.[102] The investigation later ended after a lack of evidence of Marshall's role in the incident.[103]

Innocent until proven guilty 10 times lol

I hope we put him in the ring of honor someday

He's bi polar, that's the whole reason he's running around getting awards for awareness. He should be commended, this is nothing new.
He will tell you he was a fuck up, since he admitted it sought treatment in 2011,he's been a great citizen.

He will not be suspended, at worst he ran like a bitch in a mob after his wife had her face bashed in. Nothing I've seen says he's guilty, just that no one knows the truth. The girl admitted she wrongly assumed he started the rumble and attacked him outside. He was already fleeing. The girl just wants a pay day.

This is a lawsuit, the police determined nothing happened 4 years ago.

Ok she wants a payday but it is OK for Richardson to want a payday in a year or two. Marshall hit his wife also & she tried to stab him (if I am right on three different nights.......Boy they area great couple. LOL

The police determined that no laws were broken or there was not enough evidence on him?

He cared about his wife that night but he smashed her on another night?

She was so grateful that she stabbed him on even another night.

Love American Style I guess!

"no one knows the truth" well they all do it is someone(s) is not telling the truth.

Lets find out more before we judge him from 2011 on.

Bottom line is we really don't know much at this time about what happened & I don't think based on what we hear at the moment he will miss any games or be around any sharp knives.

So lets wait & see what happens.

NEW YORK -- The jury at a civil trial has decided that a California woman did not prove she was punched by New York Jets receiver Brandon Marshall outside a Manhattan nightclub four years ago.

The decision was rendered Friday.

On Thursday, Marshall told the jury that he feared for his life while fleeing the nightclub after fights broke out.

Christin Myles, of Chino, California, testified earlier that she knew it was Marshall who punched her in March 2012 because she saw his tattooed forearm. Her lawsuit sought unspecified damages.

Marshall said he did not punch her. Video seemed to show his arms covered by sleeves when he was outside.

Marshall was never criminally charged.
