so you are basically saying that if what geno allegedly did in the lockerroom happened to you in florida, something you have called an assault, that you would have no problem shooting that person?
I don't call it an assault, the law does. Assault
Definition
1. Intentionally putting another person in reasonable apprehension of an imminent harmful or offensive contact. No intent to cause physical injury needs to exist, and no physical injury needs to result. So defined in tort law and the criminal statutes of some states.
I'll tell you a story that happened when I first moved to Florida. I was standing out in front of my office smoking a cigarette about 10am. A car pulled up across the street. A girl in her early 20's got out with a big guy mid 40's. (turned out it was her step father, and he was from LI. The girl went up to the door, the big guy stood bock about 10 feet. When the door opened the girl, and the young guy who opened it, started screaming at one another. The big guy started screaming at the kid. The kid kept on yelling at him "Get off my F N property". The big guy raised his hand and started coming at him, Bang, Bang. The big guy got shot in the chest twice and died.
The cops came and asked me what I saw. I told them. The girl, as hysterical as she was , said pretty much the same thing.
They took the kid with them. when I went to work the next morning, the kid was home. No charges of any kind were pressed.
Wouldn't have shot Smith in a locker room, figure he wasn't armed, I would have hit him, but if it happened from a stranger in the street.......... I don't know
