Both ray rice and ap had court cases in which they admitted they were guilty publicly. Brady doesn't have anything that consisting behind his punishment.

It doesn't matter.

In this process it is not the judges job to determine if Brady is guilty or not. The NFLPA has, by labor compromise, given the commissioner arbitrary power to discipline players for infractions of the rules that are not specificity covered in the CBA.

The judges only job here is to determine if the commissioner operated with in the letter of that agreement. He did.

This whole thing should have been resolved in about a week. Judge overstepped his authority, and made this case into something it isn't. Look at Home Owners Association agreements. People surrender their civil liberty to live in a certain development. Many people have lost their homes because the choose to fly an American flag. The court has been consistent in upholding HOA's. The "victim" agreed to the contract, and surrendered his rights as described in the Bill Of Rights.. PERIOD

Reading through multiple posts, it's clear that you don't understand the ruling, abs trust me the media doesn't know how to properly report anything.

Sheldon was guilty of 4 failed drug tests in a process that is clearly detailed in the cba. His first failed test they warned him (didn't happen to Brady. ) each drug test has double redundancy to prevent a false positive. The cba has a clear procedure and clear punishment where the commissioner had zero discretion.

What the judge used as his explanation I believe is incorrect. In one sentence he's claiming the nfl needs a more legal system type cba for every possible violation, that's not realistic. Then he claims Brady wasnt warned, except if a legal system is the example, you can't claim ignorance in court. The government doesn't need to verbally warn you murder is illegal before charging you. It's hypocritical.

I do believe the judges action was correct in one respect, if he believed the process was invalid, he had to invalidate it, or throw it out. He had no power to modify it, reduce games or fines etc. So he did his job procedurally but was wrong in his reasoning.

Wells claims to have messages from Brady on the equipment guys phones. Verizon saves my messages, infirm Brady he must comply with investigators or be punished, request his backed up messages. Reinvestigate the case.

And the judge claims Goodell was partial against Brady. That's absurd! Everyone knows Goodell is best friends with kraft, and Brady should have been suspended for the super bowl. Then, this investigation took months to play out, the opposite of a witch hunt.

In reading your response and the 5-6 others after it, you guys have gone straight legal and political now huh. I will admit I dont know or understand all the rulings here. I dont think most of us do but it sounds to me like you have a better understanding of it. Seems like you guys want Shelton to find any loop hole he can to clear him because that's what happened for Brady and I'm cool with that.

Seems your saying exceptions were made for Brady as a whole that were not made for other players, meaning black players. I get that but when has that ever not been the case? Besides, with Shelton actually committing a crime that the NFL has written rules against and Brady not committing a crime that the NFL doesn't have rules against, that is the loop hole right there for Brady to fight through. Where is the loop whole for Shelton to fight through?

I believe the judge is pro union not racist within the context of this ruling.

The racist claims on this thread are sarcastic or ill informed. The claim that ray rice and ap were racially discriminated against because they didn't win an appeal is wrong because they did appeal and they did win. But they also both confessed to being guilty of crimes in criminal courts.

Brady claimed his innocence in a work place arbitration, not criminal court. And this judge through out the whole punishment based on the process, similar to a court case being thrown out because of an unfair trial.

I can go with this. Besides the fact the man didn't commit a crime, never admiitted to doing anything wrong eventhough he did, the league couldn't prove he did anything wrong and last, this to me was all gamesmanship and falls into what players have been doing for decades anyway. So this was big deal to me.

Well we don't know what the physical proof is, but the nfl in the wells report claims to have text messages from Brady that give instructions to the equipment guys. So that is evidence right there.

This ruling says that the nfl's procedure was incorrect, not that Brady is innocent. The nfl is appealing, and could in theory, Reinvestigate and re penalize Brady using the standards this judge ruled necessary.

as i never read the wells report, is the underlined part true? i know there were texts between brady and the equipment guys, but are there texts that specifically give instructions to them to deflate the balls? because that would seem like a smoking gun, and my understanding was that there was no smoking gun. only circumstantial evidence.

They do have a rule against it. The ball must be inflated with in a set PSI range. The punishment is not defined, and left to the commissioner ..

IN the Richardson case his punishment for failing 3 drug tests is clearly defined in the CBA. The gray area comes with his recent arrest. There is no specific rule against doing 143 MPH with a child in the car. It falls under the "behavior detrimental to the NFL" rule. As does punching your girlfriend in the face, or beating your kid with a stick.

The punishment is left up to the commissioner, as defined in the CBA.

Ham is just being dramatic, and intentionally defending an indefensible silly position to make a point.

So I guess we'll see what happens then. My question is by the time the appeal process is done and a decision is made, Brady will probably be ready to retire so what's the point?

As I've heard from lawyers on wfan, the messages from Brady joke about psi, he makes puns, and in 1 or more messages reams out the one guy for the ball pressie after a loss.

Further, this was a conspiracy to violate a rule, evidence was destroyed.

The point is that in the legal world we live in, precedent matters. If this ever happens again, the future legal team will say Brady did it and received no punishment. Everyone must be penalized equally.

The point is to keep the integrity of the CBA in tact.

If this stands every suspended player will be taking his case to federal court.

Yeah, to a point. The NFL will have to pay their own lawyers.

Any case that is accepted by the federal court is paid for by the tax payers. A Florida women took Burger King to federal court because they were out of a burger they had advertised. You paid for that to.

Anyone see the cameras zoom in on Richardson last night? He was sitting there looking sloppy. I hope he takes these five weeks to get into really great shape and come back with a vengeance.
I mean the only thing missing was a joint hanging out of his mouth.:D

It appears that way, and in the beginning I agreed but it has been explained that the posters were being satirical to prove a point that if you complain and make ridiculous allegations, you'll get off in court due to technicalities.
